These Terms govern your use of the Push-up Track mobile application (“the app”). By installing or using the app, you agree to these Terms. If you do not agree, please uninstall the app.
1. What the app is
Push-up Track is a fitness utility that uses your device's camera and on-device AI to count push-ups, score form, and track your workout history locally. It is not a medical device, not a substitute for professional fitness coaching, and not a substitute for medical advice.
2. Health and safety disclaimer
Exercise involves risk of injury. By using the app, you acknowledge and agree:
- You are voluntarily participating in physical activity at your own risk.
- You should consult a qualified medical professional before starting any new exercise program, especially if you have a pre-existing condition, are pregnant, are recovering from injury, or are over the age of 35 and have not exercised regularly.
- You will stop immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any other symptom of physical distress.
- Rep counts, form scores, and program recommendations produced by the app are estimates generated by an on-device AI model. They may be inaccurate. They must not be relied upon for any medical, diagnostic, rehabilitative, or competitive purpose.
The developer is not liable for any injury, loss, or damage arising from your use of the app.
3. Camera use
The app requires camera access to count push-ups. By granting camera permission you agree that:
- You will only use the app in a location where you are entitled to point a camera (your home, gym, etc.).
- You are responsible for ensuring no one else is captured by the camera without their consent.
- You will not use the app to record or transmit video of others. The app itself never records or transmits video — but you are still responsible for the physical environment the camera is pointed at.
4. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from the app, except to the extent expressly permitted by applicable law.
- Use the app for any unlawful purpose.
- Use the app in a way that could damage the developer, other users, or any third party.
5. Intellectual property
The app, its code, its design, its assets, and its name “Push-up Track” are the property of Codes and Chips, except for clearly identified open-source components which are governed by their respective licenses (MediaPipe by Google under Apache 2.0; .NET MAUI by Microsoft under MIT; SQLite in the public domain). The source code itself is published under GPL-3.0.
You are granted a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely for personal, non-commercial purposes.
6. Warranty disclaimer
The app is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
You use the app at your own risk.
7. Limitation of liability
To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use of (or inability to use) the app.
In no event shall the developer's total liability to you exceed the amount you paid to download the app, which for the free version is zero.
8. Changes to these terms
We may update these Terms from time to time. Material changes will increment the Terms version and you will be asked to re-accept on the next launch. Continued use of the app after acceptance constitutes acceptance of the updated Terms.
9. Termination
You may stop using the app at any time by uninstalling it. The developer may discontinue or change the app at any time without notice.
10. Governing law
These Terms are governed by the laws of the Philippines, without regard to its conflict-of-law provisions. Disputes shall be resolved in the courts of the Philippines, unless local consumer-protection law in your jurisdiction provides otherwise.
